PRIVACY POLICY

This Privacy Policy applies to the websites and subdomains (“Sites”) owned and operated by Get a Laddah Entertainment, Inc., its subsidiaries, affiliates, and dbas, including Walsh Voiceover Coaching, and David Walsh (“Company”), and related software, applications, and other services provided by us and on which a link to this Privacy Policy is displayed. 

We know that you care how information about you is used and shared. This Privacy Policy explains what information of yours will be collected by the Company when you access the Sites, how the information will be used, and how you can control the collection, correction, or deletion of information. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. 

This Privacy Policy is incorporated into, and is subject to, the Company Terms of Use (“Terms”) found here. Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms. 

Information We Collect

(a) User-provided Information. When you use or visit the Sites, you may provide, and we may collect, personal data. We collect personally identifiable information that you provide to us on our “contact us” form. We will use your information to respond to you about the reason you contacted us. We also request information that you provide to us on our “online payments” form. To make a payment, you must provide contact information (like name and e-mail address) and financial information (like credit card number, expiration date). This information is used for billing purposes. If we have trouble processing an order, we’ll use this information to contact you.

(b) Automatically Collected Information: When you use or visit the Sites, we may automatically record certain information from your device by using various types of technology, including cookies. This “automatically collected" information may include IP address or other device address or ID, web browser or device type, the web pages or sites visited just before or just after using the Service, the pages or other content viewed or interacted with on the Sites, and the dates and times of the visit, access, or use of the Sites. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site and identify repeat visitors to our Sites. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. We use “cookies” on our Sites. Some of our business partners may use cookies on our site (for example, advertisers). We have no access to or control over these cookies, however.

(a) We use the information that we collect to operate and maintain our Sites and to respond to your questions, inquiries, or concerns. 

(b) We may use your email address or other information to contact you (i) for administrative purposes such as customer service, to address intellectual property infringement, right of privacy violations or defamation issues, or (ii) with updates on promotions and events, relating to products and services offered by us and by third parties we work with. You have the ability to opt-out of receiving any promotional communications as set forth below. We will not share any personal information with third parties for their direct marketing purposes to the extent prohibited by California law. If our practices change, we will do so in accordance with applicable laws and will notify you as required.

(c) We use automatically collected information and other information collected through cookies and similar technologies to: (i) personalize our services, such as remembering your information so that you will not have to re-enter it during a visit or on subsequent visits; (ii) provide customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of services and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (v) track your entries, submissions, and status in any promotions or other activities on the Service. How We Share Your Information

Except as described in this Policy, we will not intentionally disclose personal information that we collect or store to third parties without your consent. We may disclose information to third parties if you consent, as well as in the following circumstances:

(a) Unrestricted Information. Any information that you voluntarily choose to include in a public area of the Sites will be available to anyone who has access to that content.

(b) Service Providers: We work with third party service providers who provide website, application development, hosting, maintenance, and other services for us. These third parties may have access to, or process personal data as part of providing those services for us. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information.

(c) Non-personally Identifiable Information: We may make certain automatically collected, aggregated, or otherwise non-personally-identifiable information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding the interests, habits, and usage patterns for certain programs, content, services, or functionality of our Sites.

(d) Instances Where We Are Required To Share Your Information: The Company will disclose your information where required to do so by law, if subject to subpoena or other legal proceeding or if we reasonably believe that such action is necessary to (i) comply with the law and the reasonable requests of law enforcement; (ii) to enforce our Terms or to protect the security or integrity of our business and its services; or (iii) to exercise or protect the rights, property, or personal safety of the Company, our users, or others.

(e) Testimonials: We may display personal testimonials of satisfied customers on our Sites in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you may contact us at info@thetruetell.com.

Storage and Processing

Your information collected through the Sites may be stored and processed in the United States, Europe, or any other country in which the Company maintains facilities. The Company may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or European Economic Area, please note that we will not transfer information, including personal data, to a country outside of the European Union or European Economic Area.

How We Protect Your Information

The Company is concerned with protecting your privacy and data. We take precautions to protect your information. When you submit sensitive information through the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.

But we cannot ensure or warrant the security of any information you transmit to the Company or guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of any of our industry standard physical, technical, or managerial safeguards. When you enter sensitive information on our contact or payment forms, we encrypt that information using secure technology. No method of transmission over the Internet or method of electronic storage is 100% secure, however. Therefore, we cannot guarantee its absolute security. We use an outside help platform and a credit card processing company to bill you if you purchase services. These companies do not retain, share, store, or use personally identifiable information for any other purposes.

Privacy Shield

The Company self-certifies compliance with EU-US Privacy Shield at the U.S. Department of Commerce. The Company complies with the EU GDPR framework as set forth by the European Union regarding the collection, use, and retention of personal data from European Union member countries. The Company has certified that it adheres to the requirements of notice, choice, onward transfer, security, data integrity, access and enforcement. In compliance with the Privacy Shield Principles, the Company commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact us at info@thetruetell.com. The Company has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU in the context of the employment relationship.

In any matters relating to the EU-U.S. Privacy Shield Framework, the Company is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

Compromise of Personal Information

If personal information is compromised as a breach of security, the Company will promptly notify our customers in compliance with applicable law.

Your Choices About Your Information

(a) Access, Correction, Deletion: We respect your privacy rights and provide you with reasonable access to the personal data that you may have provided to us. If you wish to access or amend any other personal data we hold about you, or to request that we delete or transfer any information about you that we have obtained, you may contact us at info@thetruetell.com. At your request, we will have any reference to you deleted or blocked in our database.

You may decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of the Sites.

At any time, you may object to the processing of your personal information, on legitimate grounds, except if otherwise permitted by applicable law. If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact us immediately at info@thetruetell.com. You also have a right to lodge a complaint with data protection authorities.

(b) Opting-out from Commercial Communications: If you receive commercial emails from us, you may unsubscribe at any time by following the instructions contained within the email. Please be aware that if you opt-out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request. Additionally, even after you opt-out from receiving commercial messages from us, you may continue to receive administrative messages from us.

Do Not Track Policy

California law requires that operators of websites and online services disclose how they respond to a Do Not Track signal. Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the website or online service that a user visits, indicating that the user does not wish to be tracked. Because there is not yet a common understanding of how to interpret Do Not Track signals, we do not currently respond to Do Not Track signal. 

In the meantime, you may opt out of receiving interest-based advertising from advertising networks that may be delivered on our platform and other websites by visiting the following websites. This will opt you out of many—but not all—of the interest-based advertising activities in which we or third parties may engage. Choices you make may be browser and device specific. Our Retention of Your Information

We will retain your information only for as long as necessary for the purpose you provided it to us or we collected it from you.

Children’s Privacy

Protecting the privacy of young children is especially important. For that reason, the Company does not knowingly collect or solicit personal information from anyone under the age of 13. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. We are not responsible for the practices employed by websites or services linked to or from our Sites, including the information or content contained in them. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies.

Social Media Widgets

Our Sites include social media features, such as the Facebook Like button and other widgets, that run on our Sites. These features may collect your IP address and which page you are visiting on our Sites and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the organization providing it.

Changes and Updates

Our Privacy Policy may change from time to time, and all updates will be posted on this page. All changes to this Privacy Policy are effective when posted. The date of the latest update will be reflected in the “effective date” at the top of this page.
